CAPÍTULO I

CHAPTER I

Artículo 1

Article 1

La Confederación Panamericana de Esgrima es una entidad creada el 8 de marzo de 1951, en la ciudad de Buenos Aires, Argentina y constituida legalmente el 23 de Marzo de 1955, en la ciudad de México con el fin de desarrollar el deporte do la Esgrima en el continente Americano, estando reconocida por la ODEPA y la FIE.

The Pan American Fencing Confederation was created on March 8, 1951, in the City of Buenos Aires, Argentina and legally constituted on March 23, 1955 in Mexico City. Its main goal is the development of the sport of fencing in the American Continent. It is recognized by the ODEPA and FIE.

La sede de la Confederación radicará en el país de procedencia del Presidente en ejercicios, electo durante el último Congreso.

The headquarters of the Confederation will be in the Country where the last elected President lives.

Como símbolo de la Confederación de Esgrima Panamericana, queda establecido el siguiente Logo tipo: ( adjunto )

The symbol of the Pan American Fencing Confederation will be the annexed emblem.

Article 4

Los idiomas oficiales de la Confederación Panamericana de Esgrima, serán el español y el inglés.

The official languages of the Pan American Fencing Confederation are Spanish and English.

Artículo 5

Entre los objetivos que persigue la Confederación Panamericana de Esgrima, se encuentran los siguientes:

Among the objectives aimed by the Pan American Fencing Confederation, are the following:

  • Fortalecer los vínculos de hermandad entre las Federaciones del Continente Americano afiliadas a la misma.

·  Strengthen the ties of friendship among the affiliated Federations.

·  Promover y desarrollar el desenvolvimiento de toda manifestación que tienda a la difusión del deporte de la Esgrima en nuestro continente.

·  Encourage and develop ideas leading to the development of fencing in the American Continent.

·  Organizar los Campeonatos Panamericanos de Esgrima para mayores y/o menores de 20 años en las modalidades en que actualmente se compite: Florete masculino y femenino, Espada masculina y Femenina y Sable.

·  Organize Pan American Championships for Seniors and/or Juniors in all weapons: Men's and Women's Foil, Men's and Women' Epee and Sabre.

Son funciones de la Confederación Panamericana de Esgrima:

The Pan American Fencing Confederation has the following duties:
  • Establecer y fortalecer las relaciones entre las Federaciones de los Países Miembros.

·  Establish and strengthen good relationship among it's Members.

·  Desarrollar la Esgrima en nuestro continente mediante cursos de superación, seminarios y toda otra manifestación que tienda a este desarrollo.

·  Develop fencing in our Continent; organize courses, seminars or any other activity leading to the achievement of this goal.

·  Convocar, Reglamentar técnica y administrativamente y ayudar en su organización a los Campeonatos de Esgrima de Mayores y/o Menores de 20 años supervisando su conducción e informando periódicamente a la FIE y la ODEPA de sus resultados.

·  Organize, regulate ad assist in the administration of Senior and under 20 Fencing Championships, supervise their development, periodically informing the FIE and the ODEPA of their results.

·  Reunirse en Congreso anualmente a fin de coordinar los trabajos a seguir durante el tiempo que transcurra entre dos Juegos Panamericanos

·  Meet annually to coordinate all activities during the four years in between the Pan American Games.

·  Mantener estrecha relación con los Organismos Rectores de nuestro deporte, FIE y ODEPA formulan dale recomendaciones si así lo estimase necesario

·  Maintain good relationships with the two Organizations in charge of our Sport, FIE and ODEPA, advising them as deemed necessary.

·  Asesorar en Materia de Deportes a todas aquellas asociaciones deportivas que lo recaben.

·  Provide material assistance to any Sport Association requesting such assistance.

·  Formular el Programa de Eventos de los Campeo-natos de Esgrima que anualmente se celebren.

·  Establish schedules for annual Championships.

·  Patentizar el reconocimiento de la Confederación Panamericana de Esgrima a todas aquellas personas que por su destacada labor en favor de nuestro deporte en nuestro continente, así lo merezcan.

·  Express the acknowledgement of the Pan American Fencing Confederation to those individuals, who merit such recognition, through their work and dedication, demonstrate in the development of fencing in our Continent

·  Todas aquellas funciones que la Asamblea juzgase conveniente, para cumplir mejor con los objetivos planteados en el Artículo 5 de este mismo capitulo y que no sean incompatibles con los Estatutos y Reglamentos de la FIE y la ODEPA.

·  All those functions agreed on during the Congress which lead to the accomplishment of the objectives listed in Article 5, as long as they do not interfere with the Bylaws and Rules of the FIE and ODEPA.

Artículo 7

Article 7

La Confederación Panamericana de Esgrima, se ocupara únicamente de los asuntos que interesen y tienen relación con todo el continente americano sin intervenir en modo alguno en los asuntos Regionales que correspondan a la Confederación Suramericana de Esgrima o a la Confederación Centroamericana y del Caribe de Esgrima (ambas reconocidas por la FIE) y a las Federaciones Nacionales de los Países Afiliados.

The only matters which concern tire Pan American Fencing Confederation are those, related directly with the American Continent, without interference with regional matters concerning the South American Fencing Confederation or the Central American and Caribbean Confederation (both of which are recognized by the FIE) or any National Federation affiliated to it.

Se deja perfectamente establecido que la Confederación Panamericana de Esgrima no representará ante la FIE a las Confederaciones Regionales citadas en el Artículo 7, ni a las Federaciones Nacionales directamente afiliadas a la misma por lo que todas ellas mantienen el reconocimiento esta establecido en los Estatutos de la FIE

It is perfectly clear, that the Pan American Fencing Confederation does not represent any of the above mentioned Regional Confederations before the FIE, or any National Federation of the affiliated countries, all of which are recognized by the FIE as stated in the Bylaws.

Artículo 8

Toda vez que en nuestro continente existen actualmente países que no poseen Comité Olímpico Nacional reconocidos por el Comité Olímpico Internacional y la ODEPA, así como no poseen Federación Nacional reconocida por la FIE, la Confederación tiene la Potestad, después de consultar a los organismos Internacionales pertinentes, de invitar a participar en los Congresos Ordinarios y extraordinarios, así como a los Campeonatos Panamericanos establecidos de mayores y/o Menores de 20 años a aquellas Federaciones que no siendo afiliadas así lo solicitaren.

As there are some countries in our Continent without a National Olympic Committee officially recognized by the International Olympic Committee and ODEPA, as well as other countries without a Fencing Federation officially recognized by tire FIE, the Pan American Fencing Confederation may, after deliberating with the pertinent International organizations, invite them to participate at the Ordinary and Extraordinary Meetings and in the Pan American Junior and/or Senior Championships.

Esta medida no tendrá efecto para la participación en los Juegos Panamericanos que se celebran cada 4 años bajo el auspicio de la ODEPA, donde sólo pueden participar en los eventos programados los países reconocidos por la misma.

This exception is not applicable to participation in the Pan American Games, which are organized by ODEPA, every four years and to which, only countries recognized by ODEPA are invited.

DE LOS PAÍSES MIEMBROS

CHARTER III

MEMBERS

Artículo 9

Article 9

Son miembros por derecho de la Confederación Panamericana de Esgrima, todos aquellos países que encontrándose afiliados a la FIE acaten estos Estatutos.

All countries on the America Continent, affiliated to the FIE and willing to observe its Bylaw, are members by right.

Artículo 10

Article 10

Los países miembros de la Confederación Panamericana de Esgrima, tendrán los siguientes derechos:

Member Countries of the Pan American Fencing Confederation have the following rights:

·  Estar representados en los Congresos por un Delegado y un acompañante de los cuales ambos tendrán voz, pero solamente el Delegado tendrá voto.

· Be represented at the Congresses by a Delegate and one additional person, both of whom having voice, however possessing only one vote, that of the Delegate

·  Solicitar al Comité Ejecutivo de la Confederación que se convoque a reuniones extraordinarias siempre que el caso así lo amerite.

·  To empower the Executive Committee of the Confederation to the convocation of Extraordinary Meeting if necessary.

·  Solicitar que se le otorgue la sede de los Campeonatos Panamericanos de Esgrima de Mayores, Menores de 20 años o eliminatoria de Zona de Cadetes en tiempo y enviar la convocatoria respectiva a Confederación con tres meses de anticipación para poder ser boletinada a todos los países afiliados

·  Invite bids to and assign the location of the Junior, Senior or Cadet Pan-American Championships in timely manner, sending the established schedule to the office of the Confederation, at least three months in advance of the date of the event, that it can appropriately inform all Member Federations

·  Solicitar asesoría técnica en los casos que así lo requieran el Comité Ejecutivo de la Confederación a fin de asegurar Planes de Desarrollo o la realización de Competencias oficiales.

·  Solicit Technical advice from the Executive Committee as necessary, in order to carry out developmental Programs or in the organization of official Championships.

Artículo 11

Article 11

Los países miembros de la Confederación Panamericana de Esgrima, tendrán los siguientes deberes:

The Countries, Members of the Pan American Confederation, have the following duties:
  • Acatar las directrices que emanen de los Órganos de Gobierno de la Confederación

·  Respect the Directives issued by the Governing Body of the Confederation.

·  Estar representados en los Congresos Ordinarios y extraordinarios que convoque la Confederación.

·  Be represented at the Ordinary and Extraordinary Congresses convoked by the Confederation.

·  Estar al día en las cuotas de pago que fija la Confederación y estén prescritas en estos Estatutos, así como las cuotas de-pago establecidas por la FIE.

·  Be current with the annual dues established by the Confederation and prescribed in these Bylaws as well as the fees established by the FIE.

·  Asistir regularmente a las manifestaciones competitivas de nuestro deporte en el continente americano.

·  Participate regularly in fencing events scheduled in our Continent.

·  Informar periódicamente a la Confederación sobre los progresos de nuestro deporte en sus países correspondientes.

·  Maintain contact with the Confederation, informing it periodically of progress made in Fencing in their Countries.

Artículo 12

Article 12

Los países miembros de la Confederación Panamericana de Esgrima quedaran agrupados en tres Zonas Geográfica, atendiendo a balancear la participación de todo el continente dentro del Comité Ejecutivo y las Comisiones de Trabajo.

The Countries, Members of the Pan American Fencing Confederation are organized into three Geographic Zones, in order to give balanced representation of the Continent on the Executive Committee and tire Commissions.

Pertenecen a esta zona las siguientes Federaciones de Esgrima afiliadas a la FIE:

CAPÍTULO IV 

DE LOS ÓRGANOS DE DIRECCIÓN

CHAPTER IV

THE GOVERNING BODY

Artículo 12

Los órganos de Gobierno de la Confederación Panamericana de Esgrima son:

The governing body of the Pan American Fencing Confederation is constituted by:

·  El Congreso 

·  El Comité Ejecutivo 

·  Comisiones de Trabajo

·  The Congress

·  The Executive Committee

·  The Working Commissions

Artículo 13

Article 13

El congreso Panamericano de Esgrima estará formado por los presidentes de las Federaciones Nacionales de los países miembros o por quienes estos designen en su representaci6n, por los observadores que envíen la FIE o la ODEPA, por los Miembros del Comité y delegados.

The Pan American Congress is constituted by the President of the National Federations of the Countries affiliated or by those name to represent them, by the observers sent by the FIE or ODEPA, by the members of the Executive Committee and other Delegates.

Cada país miembro tendrá un voto en la Asamblea. Los observadores y demás delegados invitados tendrán voz pero no voto. En caso de existir empate en las votaciones, el presidente tendrá un voto para desempatarlo y solamente uno. No podrá haber representación por poder.

Each Member Country will have one vote on each issue presented during the Congress. The observers and other Delegates will have voice, but no vote. In case of equality in the voting, the President of the Confederation will have the right to cast the sole deciding vote. No one can be represented by power of attorney.

Los Congresos panamericanos de Esgrima serán ordinarios y extraordinarios.

The Pan American Congress can be Ordinary or Extraordinary

Los Congresos Ordinarios se reunirán cada año en el lugar en que se celebren los Campeonatos panamericanos de Mayores y/o Menores de 20 años. En los años en que se celebren los Juegos panamericanos, el Congreso se celebrara en la sede de los mismos en la víspera de la Inauguración o en la primera semana de realización del evento, en fecha que fije el Comité Ejecutivo previa consulta con el Comité Organizador de los Juegos y será presidida por el presidente de la Confederación Panamericana de Esgrima.

The Ordinary Congress will be held annually in the Country where the Junior ad/or Senior Pan American Championships are held. The year of the Pan American Games, the Congress will be held in the headquarter City of the Games, one day before the Opening Ceremony or during the first week of this event. The date will be set by the Executive Committee after consulting the Organizing Committee of the Games and will be presided over by the President of the Pan American Fencing Confederation.

Son atribuciones de los Congresos Ordinarios:

The Ordinary Congress has the following responsibilities:
  • Adoptar las Resoluciones convenientes al mejor logro de los objetivos y funciones de la Confederación

·  Adopt the most suitable resolutions to achieve the objectives and functions of the Confederation.

·  Elegir a los Miembros del Comité Ejecutivo.

·  Elect the members of the Executive Committee.

·  Dictar y modificar los Estatutos de la Confederación, así como Reglamentar los Campeonatos panamericanos de Mayores y/o Menores de 20 años y eliminatorias de zona de Cadetes.

·  Issue and modify the Bylaws of the Confederation and regulate the Pan American Junior and/or Senior Championships and the Zones Qualification Tournaments for the Cadets.

·  Determinar la sede de los Campeonatos Panamericanos de Esgrima de Mayores y/o Menores de 20 años y eliminatorias de zona de Cadetes.

·  Determine the site of the Pan American Junior and/or Senior Championships and of the Cadet Zone Tournaments

·  Admitir a los nuevos miembros.

·  Accept new members.

·  Otorgar las Condecoraciones establecidas a aquellas personalidades que trabajen en el desarrollo de la Esgrima en nuestra área y así lo ameriten.

·  Bestow the established awards to those persons who meritoriously worked towards the furthering of the development of fencing in the Americas.

·  Crear cuantas omisiones de trabajo estimen necesarias para auxiliar al Comité Ejecutivo, teniendo responsabilidad propia de las actividades que se les asignen, así como elegir a las personas que forman parte de las mismas mediante proposiciones de los delegados presentes.

·  Form as many working commissions as necessary to assist the Executive Committee. These Commissions have their own spheres of responsibility in their assigned activities. Their members are elected by nomination of the Delegates.

Artículo 16

Los Congresos extraordinarios se reunirán a petición fundada y por escrito de por lo menos una tercera parte de las Federaciones afiliadas a la Confederación o por el Comité Ejecutivo en pleno para la Resolución de Asuntos graves y urgentes que no puedan ser resueltas por el Comité Ejecutivo ni esperar al próximo Congreso Ordinario y sólo trataran la Agenda Anexa a la Convocatoria del mismo.

The Extraordinary Congress will meet at the request, in writing, for justifiable reasons, of at least one third of the Member Federations of the Confederation or by the Executive Committee for the resolution of serious issue which the Executive Committee cannot resolve. The urgency of the problem does not permit that it be referred to the next Ordinary Congress. At this meeting, only issues put on the agenda in connection with the convocation of the Extraordinary Meeting can be discussed.

Los Congresos se considerarán constituidos y podrán sesionar validamente con la mitad más uno de sus miembros afiliados.

The Congress is considered having a quorum if one half of the Member Federations plus one are represented.

Sus Resoluciones serán adoptadas por simple mayoría de los presentes y obligar a todos los Miembros por igual aunque no hayan contribuido a su aprobación.

All resolutions shall be considered adopted if a simple majority of the Members of the Confederation, present at the meeting, have voted in favor, and will oblige all Members, notwithstanding the fact how they voted on the resolution.

Las ponencias para cada Congreso deberán ser enviadas al presidente de la Confederación por lo menos con 90 de anticipación a la fecha comienzo del mismo para que este lo haga llegar a los demás representantes del Comité Ejecutivo las Comisiones establecidas y a los países miembros para su estudio.

All items to be put on the Agenda of the Meeting, must be sent to the President of the Confederation, at least 90 days in advance, before the date of the Congress, so that the Agenda can be mailed to all Members of the Confederation, to Members of the Executive Committee and the Members of the Commissions for study.

Artículo 19

Article 19

El Comité Ejecutivo estará compuesto por un Presidente y tres Vice-presidentes (uno para cada zona).

The Executive Committee shall be the President and the three Vice Presidents (one from each Geographic Zone).

Sus atribuciones son:

Its responsibilities are:

·  Realizar los objetivos trazados y cumplir las funciones de la Confederación Panamericana de Esgrima.

·  To attain the outlined objectives and fulfill the Pan American Fencing Confederation's objectives.

·  Cumplir y hacer cumplir las Resoluciones que emanen de los Congresos Panamericanos de Esgrima.

·  To carry out the resolutions taken during the Pan American Congresses.

·  Representar a la Confederación ante la FIE y la ODEPA únicamente en lo concerniente a los asuntos de la Confederación.

·  Represent the Confederation before the FIE and ODEPA in matters concerning the Confederation only.

·  Fijar la fecha de la celebración de los Congresos Panamericanos de Esgrima Ordinarios y cuando sea necesario, la fecha y el lugar de los Congresos Extraordinarios

·  Set the date for the Ordinary Congresses of the Pan American Confederation, and when necessary, the date and location of the Extraordinary Congresses.

·  Rendir informes periódicos de las actividades de la Confederación a los países miembros, a la ODEPA y a la FIE, sobre todo lo concerniente al desenvolvimiento de la Confederación.

·  Keep all members informed of the activities of the Confederation, as well as the FIE and the ODEPA, particularly issues concerning the involvement of the Confederation.

Artículo 20

Article 20

Los integrantes del Comité Ejecutivo serán elegidos do la siguiente forma:

The members of the Executive Committee shall be elected as follows:

·  Se harán las proposiciones de candidatura para Presidente de la Confederación atendiendo a estas propuestas se efectuara' la votación mediante el voto secreto y directo por parte de los delegados que representen a cada país en el Congreso, cada delegación tiene un solo voto y sólo uno.

·  According to nominations made by Members, the election of the president of the Confederation will be held by secret ballot, by vote of the delegates representing each country at the Congress. Each Delegation may exercise one vote only.

·  Una vez electo el futuro Presidente de la Confederación se pasara a elegir a los tres Vicepresidentes que le acompañaran en el mandato Estos Vicepresidentes serán de nacionalidad distinta a la del Presidente electo y representaran a cada una de las Zonas Geográficas estipuladas en el Artículo 12 Capitulo IV de estos Estatutos. A su vez estos Vicepresidentes serán elegidos como 1er. Vicepresidente, 2do. Vicepresidente y 3er. Vicepresidente.

·  The election of the three Vice Presidents will follow the election of the President. The three Vice Presidents will be from a different country than the President and will represent each of the Geographic Zones stipulated in Article 12, Chapter IV, of these Bylaws. These Vice-Presidents must also be elected as 1st Vice President, 2nd. Vice President and 3rd. Vice President.

·  Los Miembros del Comité Ejecutivo estarán vigentes en su cargo por un periodo de cuatro años, el tiempo que media entre dos Juegos Panamericanos, pudiendo ser reelegido en sus cargos o en otros dentro del Comité Ejecutivo.

·  The members of tire Executive Committee hold office for a period of four years, which is the time between two Pan American Games, they may be reelected for the same position or any other one in the Executive Committee.

·  Si por cualquier motivo los Juegos Panamericanos son aplazados, el Comité Ejecutivo de la Confederación convocará, inmediatamente después de ser conocido el aplazamiento, a un Congreso Extraordinario en cuya agenda de trabajo aparezca la celebración de elecciones como punto principal. El mandato del Nuevo Comité Ejecutivo elegido en este Congreso Extraordinario durará hasta los Juegos Panamericanos que se celebren pasados los cuatro años de la fecha de elección. La convocatoria a este Congreso Extraordinario deberá enviarse con dos meses de anticipación.

·  If, for any reason, The Pan American Games are postponed, the Executive Committee of the Confederation must convoke, immediately after the postponement is made known, an Extraordinary Congress, at which the elections will be the main subject on the agenda. The newly elected Executive Committee will hold office until the next Pan American Games are held, four years after the date of the election. The invitations to this extraordinary meeting must be mailed two months in advance.

·  El Comité Ejecutivo, una vez electo, recibirá inmediatamente el mandato, archivos, y valores de la Confederación de manos del Comité Ejecutivo saliente.

·  After the election, the new Executive Committee will immediately receive the files, archives, and goods of the Confederation from the outgoing Executive Committee and will assume its functions forthwith.

·  En caso de muerte del Presidente, así como de abandono probado de su cargo o imposibilidad por cualquier motivo para desempeñar su cargo, con la aprobación unánime, del resto del Comité Ejecutivo, asumirá la Presidencia el primer vicepresidente en función, hasta finalizar el mandato para el cual había sido electo el Presidente.

·  In case of vacancy occurring in the office of the President through resignation, death, removal from office, or other causes, with the unanimous consent of the rest of the Executive Committee, the Presidency will be filled by the 1st Vice President, who will hold office for the remaining term for which the President was elected.

·  Si quienes se encontraran en alguna de las situaciones previstas en el párrafo precedente fueran cualesquiera de los vicepresidentes, se procederá a elegir un reemplazante en el próximo Congreso Ordinario.

·  Vacancy occurring in any Vice Presidency shall be filled by election during the next Ordinary Congress.

Artículo 21

Las reuniones del Comité Ejecutivo serán normalmente coordinadas con las sesiones del Congreso. Deberán, sin embargo, reunirse una vez al año, bien sea durante la celebración de competencias oficiales o que se convoque a reunión en un país determinado.

The meetings of the Executive Committee will usually be held according to the sessions of the Congress. Nevertheless, they should meet once a year, either during the course of an official event or by convocation to a meeting in a certain country.

La convocatoria de reunión anual deberá estar en poder de los miembros del Comité Ejecutivo con dos meses de anterioridad, a fin de poder coordinar su asistencia o que se dispensen por escrito de su ausencia.

The letter of convocation for the annual meeting should be received by the Members of the Executive Committee two months in advance, in order to plan their attendance or to be excused by written request.

El Comité Ejecutivo, por medio de su Presidente, resultados de las reuniones efectuadas, lo más pronto posible, así' como informar también, pero dicamente del estado de las funciones a él encomendadas, a todos los miembros de la Confederación.

The Executive Committee must inform the Member Federations of the Confederation, as soon as possible, about the meeting a held and the work performed by them periodically.

Artículo 23

El Presidente del Comité Ejecutivo nombrará un Secretario Ejecutivo, un Tesorero y el personal adjunto que estime necesario para la ayuda en sus funciones. Estos serán de su misma nacionalidad y serán libremente nombrados y removidos de su cargo por el presidente del Comité Ejecutivo. Estos, a su vez, participaran en las reuniones del Comité Ejecutivo, pero solamente con voz, sin voto; teniendo solamente, funciones administrativas.

The President of the Executive Committee shall nominate an Executive Secretary, a Treasurer and the necessary staff to help him/her to fulfill his/her duties. The appointees shall be of the country of the President and may be removed from their office by the President of the Executive Committee. These persons may participate at the Meeting of the Executive Committee, but are not entitled to vote; their work is administrative in nature.

El Tesorero deberá rendir cuentas anualmente del estado de las Finanzas y valores con los que cuenta la Confederación y de los gastos efectuados por la misma.

The Treasurer must give an annual report on the finances and goods of the Confederation as well as of its expenses.

Artículo 24

El Comité Ejecutivo deberá estar presente en pleno, de ser posible, en los Congresos de la FIE, debiendo reunirse con anterioridad al comienzo del evento para mantener posiciones comunes para el desarrollo de nuestro deporte en nuestro Continente.

The complete Executive Committee must participate, if possible, at the FIE Congresses, holding a meeting before the Congress, to establish and maintain a united position on matters affecting development of fencing in our Continent.

El Presidente deberá asistir a los Congresos de la FIE obligatoriamente o hacerse representar por otra persona, designada por él de entre los restantes miembros del Comité Ejecutivo.

The President must be present at the FIE Congresses or be represented by one of the Members of the Executive Committee previously appointed by him/her.
