case, had suspicion cast upon them by this impeachment proceeding. Whereas the impeachment had been dropped, the suspicion was abroad. I said, “We cannot expect anybody who is a member of this department to be able to try the Bridges case on a deportation warrant without being subject to accusation of every conceivable kind, first, that he's leaning over backwards to condemn Bridges in order to protect himself against the accusations of Dies, Parnell Thomas and irate members of the community, and, second, that he is leaning over backwards to show Bridges favors because that's the policy and will of the Department of Labor, as implied by the resolution of impeachment - his superiors want him to clear Bridges and so he's trying to do it. He'll be accused by both sides and by counsel of both sides. He's bound to be. The government has to prosecute. The Immigration Service will prosecute, but we cannot be both prosecutor and judge in this kind of a case. The alien will have his own defense, but we have to devise a way so that we are not judging it. Shall we ask the Attorney General to try it?”

Well, all the lawyers said, “Absolutely no.” The Attorney General represents the United States and in case of appeals to the Supreme Court he has to argue the case. You can't possibly get him or any of his men
