the underground that your President (and he emphasized your President as though he had nothing to do with him) is thinking of breaking up the Supreme Court.” It was said in sort of a bantering way, but it was obviously opening the conversation.

I said, “Well, Mr. Justice, I haven't heard that. I'm sure I don't know how he would do it. Perhaps you could give me a hint.” That was my idea of the way to come back at him for a remark which he obviously shouldn't have made.

He saw that he had met a comeback. He laughed appropriately and said, “Oh well, there are some of them who would be glad to retire, and I'm sure would accommodate him if they felt sure they were going to get their salaries for life, with at least a half salary for their widows.”

I said, “Oh, Mr. Justice, really? You wouldn't do that, would you?”

“Certainly not!” said he. “I will never leave the court until I'm carried out.”

That was partly bantering, but he had opened up the subject. When I said, “You wouldn't do that, Mr. Justice?” I said it in the most polite terms, as though I would greatly regret to hear that he was retiring. I didn't say that, but the tone of voice indicated complete
