Abschrift

Neue musikalische Theorien und Phantasien von einem Künstler
Aus dem Verlagsvertrag vom 5.Dez.1905.

§2 .
Die Höhe der ersten Auflage inklusive Frei- und Rezensionsexemplare wird auf 1100 Exemplare, der Ladenpreis auf ca. 35 Pfg. für den Druckbogen festgesetzt.1 Alle sonstigen mit der Herstellung und dem Vertrieb zusammenhängenden geschäftlichen Massnahmen bleiben dem Ermessen der Verlagshandlung überlassen.

§3 .
Der Herr Verfasser verpflichtet sich, innerhalb vierzehn Tagen nach Erscheinen des Buches der Verlagshandlung die ihr aus der Herstellung desselben erwachsenen Kosten,2 sowie die für Insertion und allgemeine Vertriebs- und Geschäftsspesen in Aussicht zu nehmenden Beträge bar zu vergüten.

§4 .
Von den durch den Verkauf des Buches erzielten Einnahmen stehen dem Herrn Verfasser drei Viertel, der Verlagshandlung ein Viertel zu. Herr Dr. Schenker erhält jedes Jahr im dritten Quartal eine Abrechnung über den Absatz des Buches im vorhergegangenen Kalenderjahr nebst dem ihm danach zustehenden Betrage.3

§6 .
Die Verlagshandlung ist berechtigt,4 unter den in den obigen Paragraphen vereinbarten Bedingungen auch den Kommissionsverlag der etwaigen Fortsetzung des Werkes zu übernehmen.

From the Author–Publisher Contract of December 5, 1905.

§2 .
The print-run of the first edition inclusive of complimentary and review copies is fixed at 1,100 copies, the retail price at c. 35 Pfennigs per printed gathering.1 All other business proceedings relating to production and marketing remain at the discretion of the publishing house.

§3 .
The author commits himself to reimburse the publishing house in cash within fourteen days of the publication of the book for the costs incurred by it in production of same,2 as well as for the sums attributable to advertising and general marketing and commercial outlays.

§4 .
The author is entitled to three-quarters and the publishing house to one quarter of the net receipts from sale of the book. In the third quarter of each year Dr. Schenker will receive an account of the sales of the book in the preceding calendar year along with the payment due to him.3

§6 .
The publishing house reserves the right4 also to take over the commission-publication of any continuation of the work under the conditions agreed in the above paragraphs.

1 This print-run is confirmed by the accounts and sales reports. The retail price of the book, sewn, in 1906 was 10 Marks for 29 gatherings, i.e. 34.48 Pfennigs per gathering.

2 The book was released on or by November 13, 1906, Alphons Rothschild advanced 4,300.30 Marks on November 22, and Cotta acknowledged receipt on November 26: OJ 1/5, Diary, pp.26, 27, OJ 12/27, [1].

3 These accounts are preserved as OJ 9/32, [2] to [23] and sales reports as OJ 9/32, [24] to [37], and a handful of carbon copies as CA 131, 175, 191, 196, 198–200, [206], [208] (there may be other carbon copies elsewhere in the Cotta-Archiv).
