Hiedurch übertrage ich der Universal-Edition A.-G. Wien, das ausschliessliche, alleinige und übertragbare[sic] Urheberrecht meines Werkes (Monographie)

Vorträge über Beethovens IX. Symphonie2
--------------------------------------------------

für alle Auflagen, alle Ausgaben, alle Länder, alle Sprachen und alle Vervielfältigungsarten.

Ich verpflichte mich, kein gleichartiges oder ähnliches monographisches Werk in einem anderen Verlage zu veröffentlichen und an keinem solchen direkt oder indirekt mitzuwirken.

Die Universal-Edition ist berechtigt, Uebersetzunggen in andere Sprachen zu veranlassen. Ich überlasse ihr die Festsetzung und spätere Veränderung des Verkaufspreises.

Die Herausgabe hat spätestens innerhalb zwei Jahren nach Ablieferung des Manuskriptes zu erfolgen.

Für die Abtretung meines Urheberrechtes erhalte ich K 1000.– eintausend Kronen, welche nach Ablieferung des kompletten Manuskriptes zur Auszahlung zu gelangen haben.

I hereby asign to Universal Edition & Co., Vienna the exclusive, sole and transferable[sic] copyright of my work (monograph)

Lectures on Beethoven’s Ninth Symphony2
---------------------------------------------------

for all impressions, all editions, all countries, all languages, and all means of reproduction.

I undertake not to publish any comparable or similar work in monograph form with any other publishing house, or to collaborate directly or indirectly in any such work.

Universal Edition has the right to initiate translations into other languages. I assign to it the fixing and subsequent alteration of the purchase price.

Publication must take place within at latest two years from submission of the manuscript.

In return for the assignment of my copyright I receive 1,000.– (one thousand) Kroner, which shall be paid out upon submission of the complete manuscript.

Format: contract, typed not standard printed

FOOTNOTES

1 UE had a standard contract form, printed, with handwritten interpolations, such as was used for S's Chromatic Fantasy & Fugue (OC 52/423, October 17, 1909) and Die letzten fünf Sonaten von Beethoven (OC 52/494, August 25, 1912). By contrast, the contracts for the Niloff Instrumentations-Tabelle (OC 52/421, 30 June 1908), for Der Tonwille (OC 52/560, March 23, 1920), and that for Beethovens Neunte Sinfonie were different in structure and wording from the printed contract form, and also different from one another. Notably, the printed contract was one between UE and Schenker, whereas the typed contracts were declarations by Schenker.

2 The initial title of the monograph Beethovens neunte Sinfonie (Vienna: UE, 1912). Schenker had been invited, at the suggestion of Robert Hirschfeld, by the Vereinigung der Musikreferenten in Wien (Association of Music Critics in Vienna) to deliver “a cycle of lectures” (Vortragscyclus) “on the construction of Beethoven’s Ninth Symphony” (letter of invitation, OJ 14/44, dated September 30, 1910). The Foreword to the monograph reports this; the lectures, he reports, were never given, but: “the invitation by my publisher to transform this work into a monograph has provided the opportunity to make it accessible in a significantly expanded and enriched form to a larger public.”
