ways out. It isn't the duty of the Supreme Court to tell them what they should do. There were ways out of that situation. Why did they jump to the conclusion that it was all over?”

I said, “I don't know.”

He shook his head and had something to say about these poor lawyers who were advising everybody in the country about what they should think about everything. He said, “Well, we have our own troubles in the court, but at least we assume that the decisions are going to be read with intelligence and imagination.” Well, this one was not.

I cite this because I am sure that the so-called Supreme Court fight started that day. I am sure that Homer Cummings was the chief architect and proponent of the Supreme Court fight. I have other sources that would lead me to that conclusion. Cummings must have spoken to me three times within that week, because I went back to him on it after Wyzanski got back. I said, “I think Wyzanski's got a good idea as to how something can be salvaged.”

Homer Cummings looked over his eyebrows, smiled and said, “It is not worthwhile to try to salvage something. we will do better to let it ride and let the people know who is responsible for the destruction of the
