California AG Opinions: The California Attorney General interpreted UETA and E-SIGN quite restrictively in two noted opinions in 2002. In the first one, Opinion Number 02-112, the Attorney General held that individual county recorders do not generally have the authority to accept electronic documents for recordation in the county real-estate records. In the second one, Opinion Number 02-514, the Attorney General held that the Secretary of State is not required to accept certificates of filing that include facsimile signatures instead of original manual signatures. In assessing those opinions, note that California has not adopted the optional sections 17-19 of UETA.
